Terms of Service
These Terms of Service ("Terms") govern your access to and use of the CHOPP mobile application and related services (collectively, the "Service"), operated by CHOPP ("CHOPP", "we", "us", or "our"). Please read these Terms carefully. They contain important information about your legal rights, remedies, and obligations, including a limitation of liability and your authorization of charges.
1. Acceptance of Terms
By downloading, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not access or use the Service. You represent that you are at least 18 years old, have the legal capacity to enter into binding contracts, and are not barred from using the Service under any applicable law.
2. Description of Service
CHOPP is a behavioral commitment tool designed to help you reduce your screen time. You select apps and set a daily usage limit for each, together with a price for extra time (for example, 20 more minutes for €4.99). When you reach a limit, the app is blocked for the rest of the day. Stopping is always free. If you choose to continue, you can buy extra time at the price you set, through Apple's In-App Purchase. If you stay within your limits, you never pay anything.
3. Eligibility & Account
To use the Service, you must register using Sign in with Apple. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date. You may not share your account or allow others to use it. Notify us promptly of any unauthorized use of your account.
4. Purchases Through Apple
Purchases of extra time are made through Apple's In-App Purchase and are processed by Apple under Apple's terms. CHOPP does not receive or store your payment card details and does not hold, custody, or manage your funds.
5. When You Pay
You are charged only when you confirm a purchase of extra time in Apple's purchase sheet. CHOPP never charges you automatically, and reaching a limit never costs anything by itself. Each purchase unlocks the app for the interval shown before you buy.
6. Purchases, Donations & Refunds
Extra time is a digital service used immediately after purchase. Refund requests are handled by Apple (reportaproblem.apple.com) under Apple's policies and applicable law. The price of extra time is paid for the Service. It is not a donation to any charity, and you do not receive a donation receipt or tax deduction for it. CHOPP donates 70% of its net revenue from extra time (after Apple's commission, VAT and refunds) to charitable organizations in its own name, at least quarterly. The charity you select is a preference that guides these donations; CHOPP makes the final allocation. CHOPP is not affiliated with, sponsored by, or endorsed by any charity named in the Service.
7. Screen Time Data & Accuracy
The Service relies on device-level Screen Time and Family Controls data to determine when limits are exceeded. We do not guarantee the accuracy, completeness, timeliness, or reliability of this data. Delays, synchronization issues, device restarts, software updates, or platform limitations may affect when charges are triggered or whether they are triggered at all. You acknowledge that the Service is not a guarantee of reduced screen time and that you use it at your own risk.
8. Third-Party Services
The Service relies on third-party services, including Apple (authentication, Screen Time, and In-App Purchase). Your use of these services may be subject to their respective terms and privacy policies. We are not responsible for the acts, omissions, availability, or performance of any third-party service.
9. Prohibited Conduct
You agree not to: (a) use the Service for any unlawful, fraudulent, or unauthorized purpose; (b) attempt to circumvent, manipulate, disable, or interfere with the charge system, limit enforcement, or any security feature; (c) reverse engineer, decompile, or attempt to extract the source code of the Service except as permitted by law; (d) use the Service to harass, harm, or infringe the rights of others; or (e) access the Service through automated means or in a manner that imposes an unreasonable load on our infrastructure.
10. Termination
You may stop using the Service and request deletion of your account at any time through the app settings. We reserve the right to suspend or terminate your access to the Service, with or without notice, for any violation of these Terms, suspected fraud or abuse, or for any reason at our discretion. Upon termination, your authorization for future charges ends, but you remain responsible for any charges incurred before termination.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected. Your use of the Service is at your sole risk.
12. Limitation of Liability
To the maximum extent permitted by law, CHOPP and its operators, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service. Our total aggregate liability for any claim shall not exceed the greater of the total amount you paid to us in the twelve (12) months preceding the claim or one hundred euros (€100).
13. Indemnification
You agree to indemnify, defend, and hold harmless CHOPP and its operators, affiliates, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
14. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved through the appropriate courts or dispute resolution mechanisms available in the relevant jurisdiction. Nothing in these Terms limits any rights you may have as a consumer that cannot be waived under applicable law.
15. Changes to These Terms
We may modify these Terms at any time. When we make material changes, we will provide notice through the app, email, or other appropriate means and update the "Last Updated" date above. Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and may request account deletion.
16. Miscellaneous
These Terms, together with the Privacy Policy, constitute the entire agreement between you and CHOPP regarding the Service. If any provision is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
17. Trademarks
App names shown in the Service (for example Instagram, TikTok, or YouTube) and charity names are trademarks of their respective owners. They are used only to identify the apps and organizations you choose. CHOPP is not affiliated with, sponsored by, or endorsed by them. App icons are displayed by Apple's iOS from the apps on your device.
